1. IntroductionBy commissioning the artist, you acknowledge and agree to the following TERMS OF SERVICE. Please carefully review these terms before submitting your commission request.1.1 Eligibility: You must be at least 18 years old or of legal age of majority in your country or state to commission the artist. By agreeing to these terms, you certify that you meet this requirement.1.2 Acceptance of Commissions: The submission of a commission request does not guarantee its acceptance by the artist. The artist reserves the right to decline commissions for reasons such as a full schedule or the inability to fulfill your request.1.3 Cancellation: The artist may cancel a commission at their discretion and issue a full refund if they choose not to continue working with a client.1.4 Deadlines: Unless otherwise specified, there are no fixed deadlines for commissions; only rough estimates will be provided.1.5 Payment: Payment for commissions is required in full, either 100% in advance or 50% in advance (non-refundable downpayment) and 50% after sketch approval. My accepted method of payment is PayPal.2. Commission Process2.1 Commissioning: To commission the artist, please contact via email at [email protected] and provide a completed COMMISSION REQUEST FORM along with sufficient reference materials. Specify your preferred file size and/or color space. In the absence of specified preferences, you will receive the standard settings, which are 8.5 x 11 inches, 300 DPI, and RGB color space.2.2 Acceptance and Quote: The artist will respond to inform you whether your commission has been accepted. If accepted, a price quote will be provided. Upon confirmation of your payment method, an invoice will be sent.2.3 Price Adjustments: Prices are estimates and may be adjusted based on character or concept complexity. Work will commence only after the required payment is received.2.4 Approval Process: You will receive a sketch for approval, allowing for two rounds of changes (excluding artist errors) before additional charges apply. After sketch approval (and payment of the remaining 50%, if applicable), the artist will complete the commission. Major changes will incur extra fees, except for misinterpretations of the design or omissions clearly stated in the commission form.2.5 Delivery: Upon completion, the artist will share a Google Drive link for you to obtain a high-resolution PNG file. This link will remain active for 1 month, and it is your responsibility to download and archive the files for your use.3. Copyright and Licensing3.1 Artist's Rights: The artist retains all rights to their work, whether in digital, traditional, or print form, under the names 'Forsaken Gabriel', 'Forsaken Gabriels Creations', or Gabriel Rolon'. This includes but is not limited to using commissioned work in portfolios, prints, merchandise, and other promotional materials.3.2 Commercial Use: For commercial purposes (for profit), such as using the commission or character, an additional fee is required in addition to the original commission price. Depending on the intended licensing, you may also be subject to royalty fees. Note that this fee pertains to reproduction rights/license and not copyright ownership.3.3 Personal Use: You have the right to use your commissioned piece for personal and private purposes, including sharing it on social media and using it for icons, banners, prints, and personal devices. If unsure about usage, please contact the artist.3.4 Client's Rights: You may upload and share your commission, provided proper credit is given to the artist.4. Refunds4.1 Cancellation before Work: If you terminate your commission before work commences, you are eligible for a full refund.4.2 Partial Refund: If work has begun but has not progressed beyond the lining and coloring stage, you are eligible for a partial refund of 50%. Beyond this stage, refunds are no longer available unless negotiated on an individual basis for exceptional circumstances.4.3 Completed Artwork: Once the artwork is paid for and completed, refunds are not negotiable.5.
